All patrons, volunteers, or any person(s) / guardians that choose to enter on any property owned by the Coopersville & Marne Railway (CMR) or The Friends of the Coopersville & Marne Railway (FoCMR) to visit, pass through or participate in any event or ride is considered voluntary and subject to the possibility of physical injury, loss of life, and or loss of or damage to personal property and agree to the following waiver of liability:

By entering on to or participating, the patrons, volunteers, or any person(s) / guardians agrees to the following: Anyone who enters on to or uses CMR or FoCMR property or equipment, or who takes part in any related event or activity, does so voluntarily. By participating, the person / guardian understands that there are risks, including injury, death, or damage to personal property. To the fullest extent allowed by law, the claimant/voluntary participant releases and holds harmless CMR and FoCMR from any claims, losses, damages, costs, or attorney fees related to these risks. This agreement applies not only to the patrons, volunteers, or any person(s) as stated above, but also to their estate, heirs, family members, representatives, and anyone else who might try to make a claim on their behalf. If any claim is made, the claimant agrees that any recovery is limited to the amount of liability insurance coverage carried by CMR or FoCMR. The participant gives up the right to seek damages beyond those insurance limits. The claimant also releases and holds harmless CMR/FoCMR and its officers, directors, employees, agents, volunteers, and contractors from any claims, losses, damages, costs, or attorney fees related to these risks.

This agreement is governed by the laws of the State of Michigan, and any legal action must be brought in Michigan courts.

This document represents the waiver agreement between the parties regarding these matters. If any part of this agreement is found to be invalid, the rest of the agreement will remain in effect.
